Mesothelioma is a rare form of cancer that develops within cells of the mesothelium, the protective lining that covers the internal organs of the human body. This disease is most commonly associated with exposure to asbestos. Asbestos is a mineral with long fibers that once had many industrial uses throughout the world, including insulation and fireproofing, until it was discovered that prolonged exposure to the mineral causes serious health complications.
In spite of the myriad of medical advancements at our fingertips, there is no known cure for mesothelioma. Often times, the disease quickly deteriorates a person’s health. In other cases, people with mesothelioma may live for years in pain and anguish, without any reprieve whatsoever. Under the law, employers and individuals who have put others at risk by using asbestos may be held liable for exposing the victims to substantial health risks.
In 2011, Darcel Galliher filed a lawsuit against the RT Vanderbilt Company Inc., which was incorporated in Delaware and manufactured talc products. Galliher’s deceased husband, Michael, had worked for Borg Warner in Mannsfield, Ohio. Borg Warner was a bathroom fixtures facility where Mr. Galliher had worked in the cast shop filling ceramic molds. He worked at the Mannsfield plant from 1966 to 1968 and again from 1970 to 2005. In August of 2010, he was diagnosed with mesothelioma. He succumbed to the cancer six months later and died.
According to Galliher’s complaint, Borg Warner had used talc that was mined, sold and distributed by Vanderbilt to create molds for the ceramic tiles. The complaint further alleged that Galliher developed mesothelioma as a result of exposure to the asbestos-containing talc provided by Vanderbilt.
After a jury trial, Vanderbilt was found 100% liable for the damages to Mrs. Galliher and her husband’s estate. A jury in a Delaware state court awarded her $2,864,583, plus interest.
