Robert Gottshall was a U.S. Navy shipyard worker. He was exposed to asbestos while he worked with Navy vessels.

His claim was originally filed in California. Mr. Gottshall developed mesothelioma and then sued the Crane Co. and seventeen other defendants in 2010 because of his exposure to asbestos. A few months after he filed his lawsuit, Mr. Gottshall passed away and left his daughter to finish pursuing the suit.

The lower court issued a judgment in favor of the defendant, Crane Co. The California appeals court has just recently reversed the ruling of summary judgment in favor of the defendant, and has sent the case back to the trial court for a jury trial. When Ms. Gottshall, the daughter, sued six additional parties, the case was transferred to a Pennsylvania federal court. The Pennsylvania court had previously granted summary judgment in favor of General Dynamics Corp., a defendant in a similar case. The San Francisco, California Supreme Court used the Pennsylvania court’s ruling in determining that the Crane Co. was not liable for the injuries. They said that Mr. Gottshall should have understood the dangers of working with asbestos materials during the course of his employment.

Ralph P. North was an employee for the construction company that built the Long Island Lighting Company’s power station in Long Island, New York. The building was built from 1966-1972. The Long Island Lighting Company was later taken over by National Grid Generation LLC.

A New York state jury granted a $7 million verdict after a two-week trial. $3.5 million was largely for past pain and suffering and $3.5 million is for future pain and suffering.

The $7 million award is reportedly the largest asbestos verdict ever issued against a power company.

Mesothelioma is a rare form of cancer that develops within cells of the mesothelium, the protective lining that covers the internal organs of the human body. This disease is most commonly associated with exposure to asbestos.  Asbestos is a mineral with long fibers that once had many industrial uses throughout the world, including insulation and fireproofing, until it was discovered that prolonged exposure to the mineral causes serious health complications.

He succumbed to the cancer six months later and died.

According to Galliher’s complaint, Borg Warner had used talc that was mined, sold and distributed by Vanderbilt to create molds for the ceramic tiles.  The complaint further alleged that Galliher developed mesothelioma as a result of exposure to the asbestos-containing talc provided by Vanderbilt.

After a jury trial, Vanderbilt was found 100% liable for the damages to Mrs. Galliher and her husband’s estate.  A jury in a Delaware state court awarded her $2,864,583, plus interest.
